Rights and Responsibilities

International students are protected by Australian law.

The Australian government wants foreign students who come to Australia to study to have a positive and happy time. To ensure that you get the most out of your stay here, Australia provides high-quality educational services and upholds the rights of international students.

An essential fact sheet about overseas students’ rights and obligations while studying in Australia has been released by the Australian Government’s Department of Education. In addition to your consumer rights and obligations as an overseas student and critical information you should be aware of both before and throughout your education, this fact sheet offers vital information for student visa holders regarding living and studying in Australia.

You benefit from Australian regulations that guarantee high standards of instruction, facilities, and support services while you are in Australia as a student with a student visa. Before and after enrolling, you have the right to information about your course and the academic institution you desire to attend. Visit the Education Services for Overseas Students (ESOS) framework and Study in Australia for additional details about studying in Australia.

Rights of International Students

According to Australian legislation, international students are entitled to the following:

  • Before enrolling, get up-to-date information from the Solis Institute and your Solis agent regarding the courses, admission requirements, all costs, and modes of study.
  • Prior to or at the time of payment, you must sign a written agreement with Solis Institute. Prior to accepting the agreement, you are not required to pay any money or fees to the Institute.
  • In some circumstances, ask for a refund of the tuition you paid for the course. Your written agreement contains information on return policies.
  • Receive the education for which you paid. If Solis Institute is unable to teach your course (referred to as a provider default), the legislation has tuition protections that will allow you to be transferred to another course or claim a refund of your unused tuition payments. For more information, go to https://tps.gov.au/.
  • If you are not pleased with the outcome of the Solis Institute’s complaints and appeals processes, you can take the issue to the Overseas Students Ombudsman (OSO)
  • If you are not happy with the course you are taking at Solis and would like to move to another educational institution registered on CRICOS, request a transfer and have Solis Institute evaluate your request. On the Department of Home Affairs website at https://immi.homeaffairs.gov.au/change-in-situation/study-situation, you can find additional information regarding the effects of changing courses or educational institutions.
  • The same legal rights to workers’ compensation and superannuation under Australian employment regulations as Australian workers, as well as the same minimum pay and working conditions. Refer to the Fairwork Ombudsman for further details.
  • To assist you in adjusting to studying and living in Australia, achieving your learning objectives, and maintaining satisfactory learning progress, the Solis Institute is offering support services free of charge. For complete information, please visit Solis Student Support Services.
  • The Solis Institute’s welcoming and inclusive learning environment

Overseas students' obligations

As an international student on a student visa, you must:

  • Fulfil the requirements of your student visa.
  • For the duration of your stay in Australia on a student visa, make sure you have and have your Overseas Student Health Cover (OSHC).
